MENTAL HEALTH GAME JAM
TERMS OF SERVICE

These terms and conditions (“Terms”) apply to all content submitted to the Mental Health Game Jam (“the MHGJ”).


The Mental Health Game Jam is organized by Global Game Jam® (“GGJ”) and DeepWell DTx. GGJ and DeepWell DTx will be referred to in these Terms individually as an “Organizer” and collectively as the “Organizers.”


You agree to be bound by these Terms when you participate in or submit any content to Mental Health Game Jam (a “Submission”).

1. MHGJ Awards


1.1 Awards
The Organizers will offer awards to the best games submitted to the MHGJ. There will be three prizes as follows:

First Place: $25,000 USD*
Second Place: $10,000 USD
Third Place: $5,000 USD

*Plus consultation and mentorship with industry experts to further develop the game beyond a jam prototype.


1.1 Award Notices
Award recipients will be notified on or around 25 June 2022.


1.1 Claiming Your Award
To claim your Award, you must transmit all necessary documentation regarding disbursement of funds to GGJ via email to contact@globalgamejam.org within 72 hours of the winners being notified. Finalists who are not U.S. citizens may be required to submit additional paperwork and may be subject to additional taxes. Any finalist that fails to do so may forfeit their Award to a runner-up, at the Organizers discretion.


1.2 Game Development Award Usage
If awarded a game development grant, there are no restrictions placed on how you use the funds. 


1.3 Teams
If you are on a team, the entire team will receive a single Award. When a team submits a game, they will be responsible for designating a team lead that will be the official recipient of the Award. The team lead is responsible for allocating the budget for further game development and accounting for the use of funds.


1.4 Award Eligibility
You must be at least of legal age in your country to receive a game development grant award. If you are under the age of 18 and would like to be eligible for an Award, your parent or legal guardian must agree to these Terms on your behalf when you submit. You must be able to receive an Automated Clearing House (ACH) or wire payment and be someone to whom we can legally make a payment under U.S. law. 


1.5 Taxes
Certain Award payments may be subject to tax reporting and withholding. The Organizers do not make any determination regarding the applicability of federal, state, or local income taxes, and that responsibility for the reporting and payment of income taxes rests solely with you.

2. Evaluation of Submissions


After the Organizers’ staff perform an initial screen for eligibility, your Submission will be scored by a panel of jurors based on:

  • The topic of the Submission and how well the topic adheres to the themes of the MHGJ.

  • The accuracy and relevancy of the mental health-related information contained in the Submission.

  • The content, art, audio, and gameplay of the Submission.

  • Such other factors as determined by the Organizers.

 

The scoring rubric that will be used can be found below. The highest scoring Submissions that meet all submission eligibility criteria will be nominated as finalists. The decisions of the jury are final and are not subject to subsequent review.

Does the game support an increase in knowledge and motivate behavior change around the topics and themes of this game jam?


2.2 Innovation (10 points)


How creative is the game's approach to engaging the player around the topics and themes of this game jam?


2.3 Game play: Engagement (5 points)


How engaging (fun) is the game?


2.4 Game play: Accessibility (5 points)


How easy is it for someone to start playing?


2.5 Art (5 points)


How well is the art designed and executed and does it keep with the genre of the game?


2.6 Audio (5 points)


How well is the audio designed and executed and does it keep with the genre of the game?


 
3. Submission Eligibility Criteria


You must fulfill the following criteria to be eligible for an award:

  • Your Submission must be a functional prototype.

  • Your Submission must be uploaded to Itch.io by the submission deadline (11:59 PM PST on 22 May 2022). By submitting you agree to be bound by Itch.io’s Terms of Service.

  • You may only submit your own work. Plagiarized, forged, or other copied works will be automatically rejected.

  • The assets contained in your Submission must belong to you or be used under an appropriate license, which you agree to provide to the Organizers upon request.

  • Your Submission must include the name and title of each person on your team.

  • You may not impersonate another person or submit anything on another person’s behalf without their written permission, which you agree to provide to the Organizers upon request.

  • You may only submit one Submission to MHGJ.

  • Your submission must be created in the timeframe of the MHGJ. Previous games you have worked on will not be eligible for awards. However, you may use previously created art assets or systems from other games you may have worked on or from various asset stores as long as they are properly credited.

  • Your Submission may not contain any material that violates the intellectual property rights of any person.

  • Your Submission may not contain any material that is unlawful, obscene, defamatory, threatening, pornographic, harassing, or offensive, or that gives rise to criminal or civil liability, violates any law, contains any malicious code, or violates the privacy of any person.

  • Employees and family members of the Organizers or the jury will not be eligible for awards.

  • The Organizers may, in their sole discretion, reject any Submission for any or no reason.

4. Nonexclusive License


You are the sole owner of your Submission, subject to the licenses granted herein.


By submitting a Submission to, or otherwise participating in the MHGJ, you:


(i) Grant the Organizers a worldwide, non-exclusive, royalty-free and cost-free, unrestricted, unlimited, irrevocable, perpetual, and sub-licensable right and license to display, exhibit, perform, and promote your Submission, or any portion of your Submission, and your name and likeness in connection with the operation of their businesses, including but not limited to, the operation, marketing, and promotion of the MHGJ, DeepWell DTx, and the GGJ;


(ii) Warrant and represent that you own the Submission or otherwise have all the necessary rights, consents, and permissions to control the Submission and grant the licenses contained in these Terms, and that the public posting or other use of the Submission by the Organizers will not infringe or violate the rights of any third party.


5. Interactions with Other Participants


You are solely responsible for your interaction with other participants of the MHGJ. The Organizers are not liable for the conduct of or content posted by any participant. All participants must agree to and follow the Global Game Jam code of conduct.


6. Indemnification


You are solely liable for your Submission and agree to indemnify the Organizers against any and all claims related to or arising out of your Submission. The Organizers disclaim any and all liability for the content of your Submission.


7. Choice of Law, Choice of Forum, Consent to Jurisdiction


These Terms are governed by and construed in accordance with the laws of the United States and the state of Nevada, without regard to its conflict of laws provisions. Any disputes arising out of or relating to these Terms shall be tried in the state and/or federal courts located in Las Vegas, Nevada. The parties irrevocably consent to the personal jurisdiction of said courts and waive all arguments based on venue and convenience of the forum.


8. Severability and Integration


These Terms constitute the entire understanding between the parties regarding the subject matter and these Terms supersede all prior or contemporaneous oral, written, or electronic statements, agreements, communications, or proposals. In case any provision contained in these Terms should be found invalid, illegal, or unenforceable in any respect by a court of competent jurisdiction the offending provision shall be removed, and the remaining provisions shall be interpreted in accordance with the intent of the parties.
